1. Provider and scope
Canvas Cities (canvascities.com) is operated by Giorgio Lombisani, Bad Sodener Str. 22, 65843 Sulzbach (Taunus), Germany ("we"). These terms apply to every purchase of a spot in Canvas Cities.
2. What you buy
You buy the right to show one artwork of your choice in one specific spot of the 3D world Canvas Cities (a billboard, a poster, a yacht salon or a museum frame), together with your artist name, a title and an optional link to your website. The spot is shown permanently for as long as Canvas Cities is operated. You do not acquire ownership of the website, the 3D world or any part of it.
3. Prices and payment
Prices are shown in US dollars and are one-time payments. As a small business under § 19 of the German VAT Act (Kleinunternehmerregelung), we do not charge VAT; the price shown is the final price. The price of a spot depends on how full the city, harbour or museum already is and may rise as spots are sold; the price shown at checkout applies. Payment is made via Stripe. If your bank charges currency conversion fees, these are borne by you.
4. Conclusion of the contract
The display of free spots is not a binding offer. By clicking "Buy" you reserve the spot for 30 minutes; by completing the payment at Stripe you make a binding offer, which we accept by confirming the payment. If two people pay for the same spot at the same moment, the second payment is refunded in full.
5. Your artwork
You may only upload works for which you hold all necessary rights, and which do not infringe the rights of others. Not permitted: nudity or sexual content, violence, hate, discrimination, political or religious propaganda, advertising for third parties, and anything illegal. You grant us a non-exclusive, worldwide, royalty-free licence to display the artwork, name, title and link in Canvas Cities and in screenshots or videos promoting Canvas Cities. You remain the owner of your work.
6. Review and replacement
We check every artwork before it goes live. If an artwork does not meet these terms, we will ask you to upload a different one; your spot remains yours. We may remove content that later turns out to infringe these terms or the law. Until approval you can replace your artwork at any time using your personal upload link.
7. Right of withdrawal (consumers in the EU)
If you are a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded. To exercise it, inform us (giorgio@lombisani.de) by a clear statement (e.g. an e-mail) of your decision to withdraw. If you withdraw, we refund all payments received from you without undue delay and no later than 14 days, using the same means of payment.
Early expiry: At checkout you expressly ask us to start the service before the end of the withdrawal period and confirm that you know your right of withdrawal ends once we have fully performed the service. The service is fully performed when your artwork has been approved and placed in your spot. If you withdraw before that, you will receive a full refund.
8. Availability and liability
We aim to keep Canvas Cities available at all times but cannot guarantee uninterrupted availability. The look of the 3D world, cities and spots may be developed further; your spot keeps its city, type and comparable visibility. We are liable without limitation for intent and gross negligence and for injury to life, body or health; otherwise only for breach of essential contractual obligations, limited to the foreseeable damage.
9. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not remove protection granted by the mandatory law of the country of their habitual residence.
